1.1 These General Giveaway Terms and Conditions apply to all giveaways organized, co-organized or promoted by Auost through:
the Auost website or app;
the Auost Magazine;
newsletters, webinars or courses;
Instagram, Facebook, TikTok, X, LinkedIn or other social-media platforms;
physical or online events;
cooperation partners, prize sponsors or affiliates;
other channels expressly identified as an Auost giveaway.
1.2 Unless another organizer or co-organizer is expressly identified in the applicable giveaway announcement, the organizer is:

1.3 Where a partner, sponsor or affiliate is involved, the applicable giveaway announcement will identify whether that party is acting as a co-organizer, prize provider, promotional partner, data recipient or independent organizer.
2.1 Each giveaway announcement will provide the specific information applicable to that giveaway, including:
the organizer and any participating partner;
the participating channel or platform;
the start and closing date, time and applicable time zone;
the available prize and number of winners;
the eligible countries, participant groups and minimum age;
the actions or requirements necessary to participate;
the planned winner-selection date;
the method used to select the winner;
any applicable delivery restrictions;
a link to these General Giveaway Terms and Conditions.
2.2 Where an individual giveaway announcement contains more specific conditions, those conditions supplement these General Terms and take precedence for that giveaway. Mandatory law and applicable platform rules remain unaffected.
3.1 Participation is open to natural persons who are at least 18 years old and meet the eligibility requirements stated in the applicable giveaway announcement.
3.2 A giveaway may be limited to a particular group, including:
registered Auost au pairs;
registered host families;
Auost Magazine readers;
webinar or course participants;
event visitors;
followers of an official Auost social-media account;
users of a participating partner or affiliate.
3.3 Registration on the Auost platform is required only where expressly stated in the applicable giveaway announcement.
3.4 Participants must reside in one of the countries expressly included in the giveaway. If no country is stated, participation is limited to persons residing in Germany.
3.5 Employees of Auost, affiliated companies, partners directly involved in organizing the giveaway, the random-selection software provider and persons living in the same household may be excluded as specified in the applicable announcement.
4.1 Participation is free of charge unless the applicable campaign is expressly and lawfully structured otherwise.
4.2 No purchase, payment or paid Auost membership is required. A purchase or paid membership does not increase the chance of winning.
4.3 Consent to receive unrelated advertising or marketing communications is not required unless a legally compliant alternative method of participation is provided. Withdrawal of a separate marketing consent does not affect a valid giveaway entry.
5.1 Only the actions or requirements expressly listed in the applicable giveaway announcement are necessary for participation.
5.2 An Auost platform giveaway may require participants to complete one or more of the following:
register or maintain an active Auost account;
complete a profile with at least three appropriate images;
add a meaningful profile description;
submit an application for profile verification;
participate in a specified number of webinars;
successfully complete a specified number of courses;
complete another clearly described platform activity.
5.3 If the giveaway requires an application for verification, successful approval is required only where this is expressly stated. Otherwise, submitting a complete verification application is sufficient.
5.4 Webinar participation and course completion count only where they are recorded in the participant’s Auost account. Previously completed webinars or courses may be counted where the announcement permits this.
5.5 Depending on the relevant platform, a social-media giveaway may require participants to:
like a specified post;
follow an official Auost account;
post a comment or answer a question;
share or repost specified content;
use a specified hashtag;
mention the Auost account;
complete another clearly described action.
5.6 Likes, comments, shares, reposts or other interactions count only where they are technically visible and verifiable by Auost or the selection software.
5.7 Sharing a giveaway on a personal Facebook timeline or another person’s Facebook timeline will not be required. Shares and reposts on other platforms count only where permitted by the relevant platform and expressly stated in the giveaway announcement.
5.8 Magazine, event, partner or affiliate giveaways may require participants to:
answer a question about a Magazine article;
submit an entry form;
participate in a survey, webinar, course or event;
enter a campaign code;
comment on an article or campaign page;
complete another clearly described free participation action.
5.9 Where a partner or affiliate collects entries on behalf of Auost, the applicable announcement will identify that party and explain how the participation data is transmitted and processed.
5.10 Unless otherwise stated, each person receives a maximum of one valid entry. Multiple comments, accounts, forms or interactions do not increase the chance of winning unless additional entries are clearly explained before the giveaway begins.
6.1 The relevant start date and closing time are displayed in the applicable giveaway announcement.
6.2 Entries received or participation requirements completed after the closing time will not be considered.
6.3 For monthly giveaways, the participation period normally ends at 23:59 Central European Time on the last calendar day of the relevant month, unless another time is stated.
6.4 Auost is not responsible for entries that are delayed, incomplete or technically inaccessible for reasons outside Auost’s reasonable control.
7.1 Unless a different transparent selection method is stated, winners are selected randomly from all valid and verifiable entries using a software-based random selection tool.
7.2 Each valid participant receives one entry and has an equal chance of being selected unless additional entries are clearly disclosed before the giveaway begins.
7.3 The software may create the eligible entry pool using:
internal Auost user or participation identification numbers;
account type and account status;
confirmation that specified profile requirements have been completed;
verification-application status;
recorded webinar or course participation;
public social-media usernames and interactions;
Magazine, event, partner or affiliate entry records;
information showing whether the participant has already won during the relevant calendar year.
7.4 Only the information necessary to verify eligibility and conduct the random selection should be provided to the selection software. Identity documents, complete profile descriptions and profile photographs should not be transferred where a simple eligibility confirmation is sufficient.
7.5 The name of the selection software or its provider will be stated in the applicable giveaway information or privacy notice.
7.6 No profiling or evaluation of personal characteristics is used to determine the winner.
7.7 The draw normally takes place on the final day of the giveaway period or as soon as technically possible thereafter. The winner will normally be contacted within 48 hours after the draw.
7.8 Auost may manually verify whether a selected participant satisfies the published conditions. If the selected entry is invalid, fraudulent, technically unverifiable or submitted by an ineligible participant, the software may randomly select a replacement winner.
7.9 Auost may document the date, time, eligible entry pool and technical result of the draw for verification purposes.
8.1 Winners may be contacted through:
the email address registered with Auost;
the Auost messaging system;
a direct message from an official Auost social-media account;
a response to the winning comment;
the communication method stated by a participating partner or affiliate.
8.2 Winner notifications from Auost will be sent only through an official Auost account or an email address ending in “@auost.de”.
8.3 Auost will never request an account password, payment-card information, online-banking credentials or payment of a fee in order to release a prize.
8.4 Unless otherwise stated, the winner must claim the prize within one month after the winner notification was sent.
8.5 If the winner does not respond within this period, cannot be contacted, declines the prize or fails to provide the necessary information, the claim expires. Auost may select a replacement winner or transfer the unclaimed prize to a future giveaway.
8.6 A winner’s full name, photograph or other identifying information will be published only where this was clearly disclosed and an appropriate legal basis exists. Otherwise, winners will be contacted privately.
9.1 The prize described in the applicable giveaway announcement will be awarded.
9.2 A cash payment, exchange, transfer or substitution requested by the winner is excluded unless expressly stated otherwise.
9.3 If the advertised prize becomes unavailable for reasons beyond the reasonable control of Auost or the prize provider, an equivalent replacement prize may be provided, provided that this does not unreasonably disadvantage the winner.
9.4 Travel, accommodation, customs duties, taxes, insurance or additional expenses are included only where expressly stated.
9.5 The winner must provide complete and correct delivery information. Auost is not responsible for non-delivery caused by incorrect information provided by the winner.
9.6 Where a partner supplies or ships the prize, the partner’s identity and role will be disclosed. Statutory rights relating to defective or unsafe prizes remain unaffected.
10.1 Unless the applicable announcement states otherwise, a person who has already won an Auost giveaway is not eligible to win another Auost giveaway during the same calendar year.
10.2 This restriction is intended to distribute prizes among as many different members of the Auost community as possible.
11.1 Auost may exclude participants who:
fail to meet the published conditions;
provide false or misleading information;
use bots, scripts, fake identities or multiple accounts;
use a giveaway agency or automated entry service;
manipulate or attempt to manipulate the selection process;
breach these Terms, the Auost Community Guidelines or platform rules;
submit unlawful, discriminatory, threatening, abusive or misleading content.
11.2 An exclusion may occur after the draw if the violation becomes known later.
11.3 If no participant meets all applicable requirements, Auost is not required to announce a winner. The prize may be transferred to a future giveaway.
12.1 Participants must possess all rights and permissions necessary for any photograph, video, comment, article, story or other content submitted in connection with a giveaway.
12.2 Identifiable photographs or personal information concerning children or other persons must not be submitted without the permissions required by law.
12.3 Participation alone does not give Auost an unrestricted right to use submitted content for unrelated advertising.
12.4 Any additional publication, reposting, editing, translation or promotional use requires an appropriate legal basis, separate permission or a clearly disclosed campaign-specific condition.
13.1 A partner, sponsor or affiliate may:
promote an Auost giveaway;
provide or deliver a prize;
collect entries on behalf of Auost;
assist with winner selection;
act as a co-organizer or independent organizer.
13.2 The applicable announcement will identify the relevant party and its role.
13.3 Affiliates and promotional partners are not authorized to make additional prize promises or change the official conditions unless Auost has expressly approved the change.
13.4 Where a partner operates a separate giveaway under its own responsibility, the partner’s terms and privacy policy may apply in addition to or instead of these Terms. This will be clearly stated in the giveaway announcement.
14.1 Auost processes personal data only where necessary to:
verify participation and eligibility;
conduct and document the random selection;
prevent manipulation and fraud;
contact winners;
deliver or arrange delivery of prizes;
fulfil legal obligations and defend legal claims.
14.2 Depending on the giveaway, the processed information may include:
Auost user identification number and account status;
profile-completion, verification, webinar or course status;
public social-media username and interaction data;
Magazine, form, event, partner or affiliate entry information;
name, age or proof of age and country of residence;
contact information and delivery address of the winner.
14.3 The legal basis is generally Article 6(1)(b) GDPR because processing is necessary to conduct the giveaway and fulfil the prize promise. Article 6(1)(f) GDPR may additionally apply to fraud prevention, security, documentation and the establishment, exercise or defence of legal claims.
14.4 Giveaway data will not be used for unrelated marketing without separate consent.
14.5 The random-selection software provider, delivery companies and participating partners may receive only the information necessary to perform their respective tasks.
14.6 Where a service provider processes data on behalf of Auost, the provider will be contractually bound in accordance with Article 28 GDPR where required.
14.7 Personal data will be deleted when the giveaway has been completed and the information is no longer required for prize delivery, documentation, statutory obligations or the defence of claims.
14.8 Public comments and interactions on third-party platforms may remain visible until deleted by the participant, Auost or the relevant platform.

15.1 Unless expressly stated otherwise, Auost giveaways are not sponsored, endorsed, administered by or associated with Instagram, Facebook, TikTok, X, LinkedIn or any other social-media platform.
15.2 The recipient of information provided for an Auost giveaway is Auost or the partner identified in the announcement, not the social-media platform.
15.3 Questions and complaints concerning a giveaway must be directed to Auost or the organizer identified in the applicable announcement.
16.1 Auost may suspend, modify or cancel a giveaway where an important reason prevents or materially affects its fair and lawful completion.
16.2 Important reasons may include:
serious technical failure;
failure or restriction of the Auost platform, third-party platform or selection software;
manipulation or attempted manipulation;
a security incident;
a change in applicable law or platform rules;
cancellation or non-performance by a prize partner;
circumstances beyond Auost’s reasonable control.
16.3 Where reasonably possible, participants will be informed through the original giveaway channel.
16.4 These Terms may be amended where necessary because of legal, technical or organizational changes. Amendments will not retroactively and unfairly reduce the chances of participants who have already validly entered.
17.1 Auost does not guarantee uninterrupted availability of internet, telephone, social-media, electronic or computer systems.
17.2 Auost is fully liable for intent and gross negligence and for damages resulting from injury to life, body or health.
17.3 In cases of slight negligence, Auost is liable only for the breach of an essential contractual obligation and only for the foreseeable damage typical of the contract.
17.4 Mandatory statutory liability, including statutory rights relating to defective or unsafe prizes, remains unaffected.

19.1 German law applies. Mandatory consumer-protection rights applicable in the participant’s country of residence remain unaffected.
19.2 The German version of these Terms is authoritative in the event of differences between translations. Mandatory rights and statutory transparency requirements remain unaffected.
19.3 The documented result of a software-based random selection is final unless there is a technical error, an invalid entry or evidence of manipulation.
19.4 Legal recourse concerning the technical conduct and result of the random draw is excluded to the extent legally permissible. Mandatory statutory claims and the right to bring a matter before a competent court remain unaffected.
19.5 By participating, the participant accepts these General Giveaway Terms and the specific information contained in the applicable giveaway announcement.
